By engaging with us using our services, you agree to follow the following Terms in full. If you do not agree, please avoid using our service.

1. Acceptance of Terms

• By accessing Sabhika.com or hiring our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms form a legally binding agreement between you(Client) and Sabhika.com. If you are entering into this agreement on behalf of a company or other legal entity, you declare that you have the authority to bind such entity to these Terms.
• These Terms apply to all users, including clients, visitors, vendors, and affiliates. Your use of our services constitutes acceptance, whether or not you have signed a formal agreement. We may update these Terms at any time without prior notice, and the latest version will always be posted on our website. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

2. Scope of Services

• Sabhika.com provides a wide range of digital marketing services including, but not limited to, Search Engine Optimization (SEO), Pay-Per-Click (PPC) campaigns, Social Media Marketing (SMM), Content Marketing, Email Marketing, Website Design & Development, Branding, Local SEO, and Analytics & Reporting.
• Each project’s scope is defined by a mutually agreed proposal or service contract. Services may be offered on a one-time, monthly, quarterly, or project basis depending on the agreement. Any request for additional services beyond the agreed scope may require a new proposal and additional fees.
• We aim to deliver data-driven strategies and creative solutions customized to each client’s goals. However, marketing is dynamic, and while we guarantee professional effort and execution, we do not promise specific results such as top search rankings or exact ROI due to variables beyond our control (e.g., algorithm changes, competition).

3. Client Obligations

• Clients are required to provide timely and accurate information necessary for us to deliver services effectively. This includes access to relevant accounts (Google Analytics, Ads, Facebook, website admin, etc.), content materials (logos, images, brand guidelines), and prompt feedback on deliverables.
• Clients must designate a point of contact to facilitate smooth communication. Delays in approvals, incomplete information, or unresponsive communication can affect project timelines, quality, and outcomes. In such cases, we are not liable for underperformance.
• Furthermore, clients agree not to misuse our services or use the materials we produce for illegal, unethical, or unauthorized purposes. You agree not to resell, copy, or redistribute any proprietary processes or content developed by Sabhika.com without our prior written consent.

4. Payment Terms

• Clients agree to pay the full amount as mentioned in the proposal or invoice, as per the agreed milestones or billing cycle. Payments may be required in full upfront, in installments, or on a monthly basis depending on the service type.
• Clients agree to pay at least 50% of the total project cost prior to the opted service. Once the payment is done, the Sabhika.com team will start working on the client’s opted service project.
• We accept payments via Cash, bank transfer, UPI only. All payments are due within 7 days of invoice date unless otherwise agreed. A late fee of 2% per month may be applied to overdue payments.
• Refunds are not issued once work has begun, except in rare, pre-agreed circumstances. For long-term contracts, we require a 30-day notice for cancellation. GST and other applicable taxes will be levied as per Indian law.

Non-payment may result in suspension of services, removal of published content, or legal action to recover outstanding dues.

5. Intellectual Property Rights

• Unless otherwise specified, all creative materials including but not limited to graphics, content, designs, ad copy, and marketing strategies produced by Sabhika.com remain the intellectual property of Sabhika.com until full payment is received.
• Upon final payment, ownership of deliverables specifically created for the client will be transferred. However, we retain the right to use non-confidential portions of the work for portfolio, promotional, or internal purposes.
• Any third-party tools, stock content, plugins, or subscriptions used during service delivery will remain the property of their respective owners, and the client is responsible for maintaining their licenses post-project.
• The client may not resell or distribute our deliverables without prior written permission. Any violation may lead to legal consequences including damages and injunctions.

6.Confidentiality and Data Protection

• Sabhika.com respect your privacy and the confidentiality of your business data. Any information you share with Sabhika.com during the course of a project—including credentials, business data, strategies, or client/customer information—will be kept strictly confidential.
• We will not disclose your information to any third party without your written consent, except as required by law or necessary for service execution (e.g., using verified vendors or consultants under NDAs).
• We implement security practices to safeguard your data, but we cannot be held responsible for breaches due to client negligence (e.g., sharing credentials insecurely or unauthorized access from the client’s end).
• We do not sell, lease, or trade your data to third parties. Clients are also expected to maintain the confidentiality of our pricing, strategies, or internal processes disclosed during our engagement.

7.Termination and Suspension

• Either party may terminate the agreement with 30 days’ written notice. Termination before the completion of the agreed term may incur a cancellation fee based on the work completed.
• We reserve the right to suspend or terminate services without notice in case of:

1. Non-payment beyond 15 days
2. Misuse of services.
3. Illegal activity.
4. Abuse or harassment of our staff.
5. Repeated delays in feedback or communication.

• On termination, all unpaid dues become immediately payable. We may withhold final deliverables until all payments are settled. No refunds will be provided for services already rendered or for time reserved for your project.

8.Limitation of Liability

• Sabhika.com strives to provide high-quality services, but we are not liable for:

1. Search engine ranking changes due to algorithm updates.
2. Ads account suspension by third parties like Google or Meta.
3. Unexpected drop in leads or traffic due to factors beyond our control.
4. Business losses caused by incorrect implementation of our recommendations without consulting us.

• Our total liability under any agreement shall not exceed the amount paid by the client in the last 3 months of service. We are not liable for indirect, incidental, or consequential damages of any kind.
• Clients must compensate us against any claims, damages, or losses arising from the use of our services in ways not agreed upon in writing.

9.Dispute Resolution

• In the event of a disagreement or dispute, both parties agree to first attempt to resolve the issue amicably through discussion or written communication. If resolution cannot be reached, the dispute will be referred to arbitration.
• All disputes shall be subject to the jurisdiction of courts located in Deoghar, Jharkhand, under Indian law. Arbitration will be conducted in Hindi/English and follow the Arbitration and Conciliation Act, 1996.
• We recommend both parties retain copies of all communication and agreements to assist in any potential dispute.

10.Modifications to Terms

• Sabhika.com reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website or notifying you via email.
• We encourage you to review the Terms periodically to stay informed. Continued use of our website or services after modifications implies acceptance of the updated Terms.
• If any provision of these Terms is found to be unenforceable, the rest of the Terms shall remain in full force and effect.
